Copyright & AI-Assisted Design Policy

Unless otherwise expressly stated, the original wallpaper designs, mural designs, patterns, illustrations, compositions, graphics, product imagery, layouts, colour treatments, design elements, branding, written content, and other creative works displayed, distributed, or sold by InkScape Studio are protected intellectual property.

Copyright Ownership

InkScape Studio operates in British Columbia, Canada, and asserts its copyright and other intellectual property rights under the Copyright Act of Canada and, where applicable, international copyright conventions and the laws of jurisdictions in which those rights are recognized.

Original Digital Artwork

InkScape Studio designs are created through a digital artistic and production process. Digital creation does not mean that a work is free from copyright protection. Our finished designs may involve substantial human creative work including, but not limited to:

• Original artistic conception and creative direction

• Composition and layout

• Drawing and illustration

• Selection and arrangement of visual elements

• Pattern development and repeat construction

• Colour selection and colour modification

• Image compositing

• Digital painting

• Retouching and reconstruction

• Scaling and proportion decisions

• Masking and layer construction

• Texture development

• Manual correction and refinement

• Selection, rejection, alteration, and combination of generated elements

• Preparation and adaptation of artwork for wallpaper and mural production

InkScape Studio claims copyright in the original human-authored elements of these works and in the original selection, arrangement, editing, composition, and finished expression of those elements to the extent protected by applicable copyright law.

Use of Artificial Intelligence in Our Creative Process

InkScape Studio may use artificial intelligence and machine-learning technologies as tools within a broader human-directed creative workflow. AI technology may assist with particular stages of development, such as concept exploration, generation of source elements, visual experimentation, texture creation, image enhancement, image reconstruction, upscaling, or production assistance.

AI is not represented by InkScape Studio as the autonomous author of our finished designs. Our designs are conceived, directed, selected, evaluated, edited, combined, modified, refined, and prepared for production through human creative decision-making. AI-generated or AI-assisted material may therefore form only one component of a larger design process.

The final InkScape Studio artwork reflects human creative choices concerning such matters as composition, imagery, arrangement, colour, proportion, repetition, modification, editing, treatment, and final presentation.

Human Authorship and Creative Control

InkScape Studio's copyright claim is based on the human creative authorship embodied in its finished works. The use of an AI-assisted tool during part of the production process does not mean that all creative decisions have been delegated to artificial intelligence.

Where AI tools are used, a human designer exercises creative control over the development and final work, which may include:

• Conceiving the overall design

• Establishing the artistic direction

• Determining the subject matter and visual objectives

• Directing and iterating source material

• Selecting or rejecting generated material

• Combining multiple visual elements

• Altering shapes, forms, details, textures, and colours

• Reconstructing and repainting portions of the imagery

• Creating the final composition

• Developing the repeating wallpaper structure

• Cropping and arranging visual elements

• Correcting visual inconsistencies

• Preparing the finished work for commercial printing

• Making the final artistic and production decisions

Accordingly, InkScape Studio asserts copyright in those portions of its artwork resulting from human authorship, skill, judgment, selection, arrangement, modification, and creative expression, together with the completed work to the extent that it qualifies for copyright protection under applicable law.

Canadian Copyright Protection

Under Canadian copyright law, original artistic works may receive copyright protection automatically when they are created and fixed in a material form. Copyright protection is not dependent upon a work having been created using traditional physical media. Digital artistic works may qualify for copyright protection where the applicable requirements for copyright are satisfied.

Canadian law considers originality in relation to the exercise of skill and judgment by the author. InkScape Studio's creative workflow is designed around substantial human artistic involvement and creative decision-making, regardless of whether particular stages of production involve traditional artistic tools, digital imaging software, photographic tools, procedural tools, or artificial intelligence technologies.

AI Assistance Does Not Constitute Permission to Copy

Disclosure that artificial intelligence may have been used as one tool within the design process does not grant permission to reproduce, extract, copy, redistribute, modify, commercially exploit, or otherwise use InkScape Studio artwork.

The presence of AI-assisted elements within a work should not be interpreted as a statement that the finished artwork is in the public domain or is available for unrestricted use. InkScape Studio expressly reserves its rights in all human-authored, edited, selected, arranged, composited, and otherwise protectable portions of its designs.

Purchase of Wallpaper Does Not Transfer Copyright

Purchasing wallpaper, murals, samples, or another physical InkScape Studio product gives the purchaser ownership of the physical product supplied. It does not transfer copyright or intellectual property ownership in the artwork printed on that product.

Unless separate written permission or a licence has been granted by InkScape Studio, customers may not reproduce or commercially exploit the underlying artwork.

Prohibited Uses

Except where expressly authorized by InkScape Studio or permitted by applicable law, you may not:

• Copy or reproduce our designs

• Scan or photograph our artwork for reproduction

• Download or extract high-resolution artwork from our website

• Digitally reproduce our wallpaper patterns

• Recreate our designs for printing

• Manufacture wallpaper, fabric, prints, clothing, homewares, or other products using our artwork

• Sell or redistribute digital copies of our artwork

• Upload our artwork to print-on-demand services

• Upload our artwork to stock-image or digital-asset marketplaces

• Remove or obscure copyright notices or identifying information

• Represent an InkScape Studio design as your own work

• Create commercial reproductions or substantially copied versions of our designs

• Supply our artwork to another manufacturer for reproduction

Use With Artificial Intelligence Systems

Unless expressly authorized in writing by InkScape Studio, our artwork and product imagery may not be intentionally copied, extracted, supplied, uploaded, or submitted for the purpose of:

• Training an artificial intelligence or machine-learning model

• Fine-tuning an artificial intelligence model

• Building a commercial image dataset

• Creating a model specifically designed to reproduce InkScape Studio's artwork

• Generating substantially copied commercial designs from InkScape Studio artwork

Nothing in this section is intended to restrict a use that cannot legally be restricted under applicable law.

Inspiration Versus Reproduction

Copyright protects creative expression rather than a general idea, subject, style, theme, or artistic concept. InkScape Studio therefore does not claim exclusive ownership over general artistic ideas or themes.

However, copying the protectable expression of an InkScape Studio design, or reproducing a substantial part of a protected work, may constitute copyright infringement.

Product Photography and Website Imagery

Product photographs, wallpaper room scenes, mockups, presentation imagery, graphics, branding materials, and other website assets created by or for InkScape Studio may themselves contain separate copyright-protected elements.

Permission to view these materials through our website or social-media channels does not constitute permission to reproduce or commercially use them.

Reporting Copyright Infringement

If you believe that InkScape Studio artwork is being reproduced, sold, distributed, or otherwise used without authorization, please contact us with:

• The design or product concerned

• The location of the suspected infringement

• Website links where applicable

• Screenshots or photographs

• Any other relevant information

Third-Party Rights

InkScape Studio respects the intellectual property rights of others. Where third-party materials are legitimately incorporated into a design under licence, permission, public-domain status, or another lawful basis, ownership of those underlying materials remains subject to the rights applicable to those materials.

InkScape Studio's copyright claims do not extend to third-party material in which InkScape Studio does not own copyright.

Statutory Exceptions

Nothing in this policy is intended to prevent uses that are expressly permitted under applicable copyright law, including applicable statutory exceptions.

Reservation of Rights

Except for rights expressly granted in writing, all copyright and intellectual property rights are reserved by InkScape Studio. No licence to reproduce, manufacture from, redistribute, commercially exploit, or create unauthorized reproductions of InkScape Studio artwork is granted merely through access to this website or purchase of an InkScape Studio product.
